The Plenary Sitting at the São Paulo Board
of Trade, under motion by its President, in a
session of its Voting Members held on 02/10/04:
Whereas as provided in Article 35 of the By-laws
relating to Decree 13609 from October 21, 1943,
combined with the provisions in Article 8, Item
II, of Law 8934 from November 18, 1994, regulated
by Article 32, item I, sub-item b, of the Federal
Decree 1800 from January 30, 1996;
Whereas the emoluments of Official Translators
and Interpreters are established according to
outdated parameters, with the last readjustment
having occurred in 1998;
Whereas an equivalent value in characters must
be reached for the Official Translator's page
equivalent counting ("lauda"), fixed
in 25 (twenty five) typewritten lines;
DETERMINES THAT:
Regarding the emoluments for Official Translators
and Interpreters, with amounts expressed in Reais:
Article 1 - Texts will be divided into ordinary
and special texts:
A) - Ordinary Texts: passports, civil record
certificates, identity cards, professional certification
(Translator's Note: the original does not specify
whether it is professional driver's license or
any certification in general), and similar documents,
including personal letters that do not involve
legal, technical, or scientific texts:
Translation to Portuguese: R$ 25.00/page equivalent
("lauda")
Translation to Foreign Language: R$ 31.00/page
equivalent ("lauda")
B) - Special Texts: legal, technical, scientific,
commercial, including banking and accounting;
school certificates and diplomas:
Translation to Portuguese: R$ 35.00/page equivalent
("lauda")
Translation to Foreign Language: R$ 43.00/page
equivalent ("lauda")
Article 2 - Emoluments correspond to page equivalents
of up to 25 (twenty-five) typewritten or equivalent
lines, and for each exceeding line an increase
of 4 (four) per cent of such emoluments will be
charged.
Single Paragraph: For the purposes of this Determination,
it is understood that a group of up to 1,000 (one
thousand) characters (not including blank spaces),
is equivalent to a 25-line page equivalent ("lauda").
Article 3 - An amount corresponding to 20 (twenty)
per cent of the emoluments payable for a translation
will be payable for an authenticated copy supplied
concurrently with the translation.
Article 4 - An amount corresponding to 50 (fifty)
per cent of the emoluments paid for the original
service will be payable for an authenticated Official
Tenor of the translation if provided at a later
date.
Article 5 - In translations from one foreign
language into another foreign language, there
will be an increase of 50 (fifty) per cent over
the emoluments payable, prevailing the provisions
related to authenticated "copies" and
"tenors", respectively.
Article 6 - While acting as Interpreter Under
Oath, before prosecuting authorities, at a Notary
Public, or in similar cases, the amount of R$
87.00 (eighty-seven Reais) will be payable to
the translator/interpreter for the first hour
of services provided; an additional R$ 25.00 (twenty
five Reais) will be payable for each subsequent
quarter of an hour.
Article 7 - In cases specified in Article 6 where
the interpreter has been summoned but notwithstanding
his will the service is not provided due to dismissal
by a competent authority, emoluments of R$ 25.00
(twenty five Reais) will be payable for each quarter
of an hour.
Article 8 - In the case of services provided
outside the Municipality of São Paulo,
the amounts corresponding to transportation, meals,
and accommodation, will be previously established
among the interested parties.
Article 9 - Emoluments for a report verifying
the exactitude of a translation of another official
translator will correspond to 50 (fifty) per cent
of those established in the price list, with the
corresponding articles applied as the case may
be.
Article 10 - An addition of 50 (fifty) per cent
over the amounts established in the price list
will be charged for urgent services, and 100 (one
hundred) per cent for extraordinary services.
Paragraph 1 - An urgent service is that which
is executed and made available to the interested
party within the following time frames: 04 (four)
hours for one page equivalent ("lauda")
with 25 (twenty-five) typewritten lines; 08 (eight)
hours for two page equivalents ("laudas")
totaling 50 (fifty) typewritten lines; 12 (twelve)
hours for three page equivalents ("laudas")
totaling 75 (seventy-five) typewritten lines,
and successively and proportionately thereafter,
whereby "hours" mean the official office
hours established by the Municipality of São
Paulo.
Paragraph 2 - An extraordinary service is that
which is executed during Saturdays, Sundays, holidays
and optional holidays.
Article 11 - Cases not covered here will be resolved
by the Plenary Sitting of the São Paulo
Board of Trade when requested by the Organization
representing the Official Translators and Interpreters
in the State of São Paulo, and proposed
in writing by the Inspection Office of this Board
of Trade, whereas in this case as approved by
any interested party.
Article 12 - This Determination revokes the Determination
- Jucesp no. 03/00 issued at the Official State
Newspaper from July 17, 2000.
Article 13 - This Determination will be in force
at the date published.
